The Supreme People's Court issued the outline of the third five year reform of the people's Court (2009-2013) (hereinafter referred to as the outline of the third five year reform). In view of the main problems existing in the current judicial system of China, the Supreme People's court systematically deployed various measures for the reform of the court from 2009 to 2013. This marks the start of a new round of reform of the people's court.
"A scientific and efficient judicial system and working mechanism are the premise and guarantee of maintaining social fairness and justice." It is understood that the three five year reform outline is a new guiding document issued by the Supreme People's court after the two judicial reform documents issued in 1999 and 2005.
Jiang Huiling, deputy director of the judicial reform office of the Supreme People's court, who participated in the drafting of the third five year plan for reform, said, "after the first five year plan and the fifth five year plan for judicial reform, the people's court has developed and improved its judicial system and working mechanism to a certain extent, but there is still a big gap compared with the growing demand of the people for judicial system. In this situation, it is imminent to carry out a new round of judicial reform of the people's court. "
Looking through the "Three Five Year Plan" reform outline, "always adhere to the leadership of the party" has become the primary principle of the reform of the people's court. It is understood that the basic tasks and objectives of the judicial reform of the people's court determined in the "Three Five Year Plan" are: to further optimize the power allocation of the people's court, to implement the criminal policy of combining justice with leniency, to strengthen the team building, to reform the financial guarantee system, to improve the mechanism of judicial work for the people, to strive to solve the contradiction between the growing judicial needs of the people and the relative lack of judicial capacity of the people's court, and to promote We will promote the self-improvement and development of the socialist judicial system with Chinese characteristics and build a fair, efficient and authoritative socialist judicial system.
In order to ensure the scientificity and feasibility of the court's reform measures, the Supreme Court began to conduct in-depth research on the judicial reform sub topics from the beginning of 2008. For the key links of the reform, it strives to have accurate data statistics and analysis as support. At the same time, the people's court also extensively solicited opinions and suggestions from local Party committees and governments, deputies to the National People's Congress, members of the Chinese people's Political Consultative Conference, experts and scholars, as well as all sectors of the society. In particular, it listened to the opinions of the people at the grass-roots level and the front-line police, made repeated modifications and improvements, and finally formed 30 reform measures involving five aspects.
